1. ACCEPTANCE OF GENERAL TERMS AND REGISTRATION

Kagoshima Records is operated by Edmondo Cetrangolo, Via Roma 1, Vibonati, SA, Italy, VAT No. IT06033050656.

1.1 – Only customers of legal age may register on the website. Registration is completely free. Registration credentials (email and password) must be used exclusively by the Customer and cannot be transferred to third parties. The Customer agrees to keep them confidential and to notify Kagoshima Records immediately if they suspect misuse or unauthorized disclosure. Each Customer is allowed to register only once. If Kagoshima Records detects multiple registrations, it reserves the right to block duplicate accounts without prior notice.

1.2 – The Customer guarantees that all personal information provided during registration is truthful and complete. The use of false or invented names is strictly prohibited. The Customer agrees to indemnify Kagoshima Records from any damages, liabilities, or sanctions related to the misuse or misrepresentation of registration credentials.

1.3 – The contract between Kagoshima Records and the Customer is considered concluded upon acceptance, even partial, of the order. This acceptance is implicit unless otherwise communicated. By placing an order, the Customer declares to have read and accepted all the conditions described herein.

1.4 – If the Customer is a consumer (i.e., a natural person purchasing goods not for professional purposes), they are required to save or print a copy of these Terms, pursuant to Articles 50 and following of Italian Legislative Decree No. 206/2005.

1.5 – No compensation or indemnity will be due to the Customer for non-acceptance of an order.

1.6 – The product catalog, including prices, discounts, promotions, and availability, is valid only for purchases made on the e-commerce website and does not apply to any physical store.

1.7 – By accepting these Terms, the Customer consents to receiving promotional SMS and newsletters. This consent can be withdrawn at any time via the unsubscribe link in the newsletters or by contacting customer service.

2. ORDERING METHODS

2.1 – Customers may purchase only products available in the online catalog at the time of the order, as described in the product pages. Product images may differ slightly from actual products and are for illustrative purposes only. For detailed specifications, Customers should refer to manufacturer websites.

2.2 – There is no minimum order amount.

2.3 – Orders received by 10:00 AM on business days are typically processed the same day. Order processing refers to shipment to the courier. Delays may occur and Kagoshima Records is not responsible for such delays.

2.4 – To modify an order, Customers must email customer service indicating the order number and desired changes. Changes are not guaranteed due to the rapid processing of orders.

2.5 – Kagoshima Records reserves the right to cancel or suspend orders deemed irregular (e.g., unusual quantities, frequent unpaid orders).

2.6 – Orders may be refused or cancelled if false or incomplete information is provided, if there is an ongoing legal dispute, or for past violations of these Terms.

2.7 – Order confirmation will be sent by email, including date, time, and order number. Customers must verify all information and report any errors promptly.

2.8 – If the order is not accepted, Kagoshima Records will promptly notify the Customer.

2.9 – International Customers can request a shipping quote by providing a complete delivery address and item codes/quantities. Quotes are provided without obligation.

3. PAYMENT METHODS AND INVOICING

3.1 – For credit card payments, charges will be applied at the time of order placement.

3.2 – For PayPal payments, charges are applied simultaneously with order creation.

3.3 – Kagoshima Records may request additional verification (e.g., landline number or cardholder ID). Orders may be declined if documentation is not provided.

3.4 – Kagoshima Records does not access credit card or PayPal data, which are transmitted directly to the payment processor via secure connection.

4. SHIPPING – DELIVERY CHARGES, TIMES, AND METHODS

4.1 – Shipping fees vary according to destination country, total cart amount and number of records purchased calculated in weight. For more info check the Shipping Policy Page or see the price calculated at checkout

4.2 – Orders received by 11:00 AM on working days are shipped within 24 business hours; otherwise, within 48 hours. Delays may occur. Delivery takes 24–48 hours in most areas; add 24–48 hours for remote areas and islands.

4.3 – Orders can only be shipped within Italy, San Marino, and Vatican City.

4.4 – Couriers such as Fedex is used; customers cannot choose the courier.

4.5 – Delivery times are determined by the courier. Specific time slots cannot be requested.

4.6 – By accepting these Terms, the Customer agrees to share their phone number with the courier. Delivery is to ground floor only.

4.7 – Kagoshima Records is not responsible for courier delays or damage after shipment.

4.8 – Upon delivery, Customers must verify that the package is intact and matches the shipping document. Damage or discrepancies must be noted on the delivery slip with a specific reason (e.g., “damaged box”). After signing, no claims can be made. Any issues must be reported within 3 days via the contact page.

4.9 – If delivery fails, the courier will leave a notice and try again the next business day. If delivery fails again, Kagoshima Records will contact the Customer to arrange redelivery.

4.10 – If not collected within 5 working days, the package returns to Kagoshima Records. Reshipping is subject to additional charges.

5. RIGHT OF WITHDRAWAL AND RETURNS

5.1 – In accordance with Articles 64 and following of Italian Legislative Decree No. 206/2005, consumers may withdraw from the contract within 14 calendar days of receiving goods.

5.2 – To exercise this right, Customers must email customer service within 14 days, including the order number, item codes and quantities, full name, bank name, and IBAN for the refund.

5.3 – Conditions for withdrawal:

Customers must await a response from customer service.

Return shipping costs are the Customer’s responsibility.

Only complete products may be returned.

Custom or made-to-order items are non-refundable.

Items must be returned in original condition and packaging.

Do not apply tape or labels directly to original packaging.

Packages must be sent to the address provided by customer service.

Customer is responsible for return shipping until received.

Returned products are inspected; damaged items may incur a deduction from the refund.

5.4 – Withdrawal rights are void if the product shows signs of use, is incomplete, damaged, or altered.

5.5 – Refunds are issued via bank transfer within 15 days after goods are received and verified.

6. WARRANTIES

All products sold by Kagoshima Records are covered by the manufacturer’s standard warranty. To receive warranty assistance, the Customer must retain the purchase invoice.

6.1 – The warranty applies to products with a conformity defect, provided they are used correctly, in accordance with their intended use and with the instructions in the technical documentation. This warranty is reserved for private Consumers (natural persons purchasing goods for non-professional purposes and not indicating a VAT number at the time of order). In case of a conformity defect, Kagoshima Records will restore the product’s conformity free of charge by repair or replacement, or, if this is not possible, offer a price reduction or terminate the contract.

6.2 – If, for any reason, Kagoshima Records is unable to return a product under warranty (repaired or replaced), it may, at its discretion, refund the purchase price considering the usage or replace it with a product of equal or higher value.

6.3 – Repair or replacement times depend exclusively on the manufacturer’s policies. Kagoshima Records cannot be held liable for delays in repair or replacement.

6.4 – When warranty application involves the return of a product, the item must be returned in its original packaging, complete with all components (including packaging, documentation, and accessories such as manuals). To prevent damage, we recommend placing the original packaging inside another box. Labels or adhesive tape must not be applied directly to the original product packaging. The Customer will receive return authorization via email. The return must be sent to Kagoshima Records, Via Roma 1, Vibonati (SA), Italy. Shipping is the responsibility of the Customer.

7. PRIVACY

7.1 – Personal data collected when placing an order is processed in order to fulfill the Customer's requests. Kagoshima Records ensures compliance with applicable privacy laws, specifically Regulation (EU) 2016/679 (GDPR) and Italian Legislative Decree No. 196/2003. 7.3 – The sales contract between the Customer and Kagoshima Records is considered concluded in Italy and governed by Italian law. For civil or criminal disputes arising from the remote sales contract, if the Customer is a consumer, the territorial jurisdiction is that of their municipality of residence; in all other cases, jurisdiction lies exclusively with the Court of Salerno.
